These Terms of Service (“Terms”) govern your use of BrainCrumb: the iOS app, the web dashboard at captures.braincrumb.app, and this website (together, the “Service”). By creating an account or using the Service, you agree to these Terms.
The service
BrainCrumb lets you capture text, voice, and photos; automatically enriches captures with context such as time, location, weather, motion, and calendar events (subject to the permissions you grant); classifies and transcribes captures using AI; and lets you search, export, and hand captures off to other systems such as Contacts, Calendar, and Reminders.
Your account
You need an account to sync and access captures across devices. Authentication is provided by Clerk. You are responsible for keeping your sign-in credentials secure and for the activity that happens under your account. You must be at least 13 years old to use the Service.
Your content
Your captures are yours. You retain all rights to the content you save in BrainCrumb. You grant us a limited license to store, process, and transmit that content solely to operate and provide the Service, for example transcribing a voice note, classifying a capture, generating search embeddings, or syncing to your other devices. This license ends when you delete the content or your account.
You agree not to use the Service to store or share content that is unlawful, infringes others’ rights, or contains malicious code, and not to abuse, probe, or disrupt the Service.
AI features
Transcription, classification, and semantic search are powered by AI models (Cloudflare Workers AI). AI output can be wrong: transcripts may contain errors, and captures may be filed under the wrong category. Review AI-generated results before relying on them, especially before exporting a contact, event, or reminder to another system.
Availability and changes
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We may add, change, or remove features, and we may suspend or discontinue the Service. Where practical, we will give notice of material changes and an opportunity to export your data. The iOS app is currently in pre-release; features described on this site may change before public availability.
Limitation of liability
To the maximum extent permitted by law, BrainCrumb and its operator will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost data, lost profits, or loss of goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and US $50.
Termination and deletion
You can stop using the Service at any time. To delete your account and all associated data, email erikkwilder@gmail.com from the address on your account. We may suspend or terminate accounts that violate these Terms.
Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which the operator of the Service resides, without regard to conflict-of-law rules.
